{"id":434,"date":"2026-06-13T11:03:48","date_gmt":"2026-06-13T11:03:48","guid":{"rendered":"https:\/\/northcarolinamovingjournal.com\/?p=434"},"modified":"2026-06-13T11:03:48","modified_gmt":"2026-06-13T11:03:48","slug":"judge-blocks-trumps-anti-weaponization-fund-until-government-agrees-its-been-dissolved","status":"publish","type":"post","link":"https:\/\/northcarolinamovingjournal.com\/?p=434","title":{"rendered":"Judge blocks Trump\u2019s \u2018anti-weaponization\u2019 fund until government agrees it\u2019s been dissolved"},"content":{"rendered":"<div>\n<p>ALEXANDRIA, Va. \u2014 A federal judge in the Eastern District of Virginia issued a preliminary injunction Friday halting the Trump administration\u2019s nearly $1.8 billion \u201canti-weaponization\u201d fund for one week, giving the government time to sign a \u201cclear, unambiguous\u201d agreement that the fund is dead.<\/p>\n<p>Read more <a href=\"https:\/\/northcarolinamovingjournal.com\/?p=432\">Republicans axe NC State student center as an early voting site<\/a><\/p>\n<p>U.S. District Judge Leonie Brinkema said from the bench the agreement must be signed by acting Attorney General Todd Blanche and Treasury Secretary Scott Bessent.<\/p>\n<p>\u201cThe balance of harms tips in the favor of the plaintiff,\u201d said Brinkema, a Clinton administration appointee.<\/p>\n<p>Brinkema had already temporarily\u00a0blocked the fund on May 29 on an emergency basis.\u00a0\u00a0<\/p>\n<blockquote><p>Whatley backs Trump\u2019s $1.8B \u2018anti-weaponization fund\u2019 despite GOP revolt on Capitol Hill<\/p><\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" data-secret=\"vSKhO8kAWV\" frameborder=\"0\" height=\"282\" marginheight=\"0\" marginwidth=\"0\" sandbox=\"allow-scripts\" scrolling=\"no\" security=\"restricted\" src=\"https:\/\/ncnewsline.com\/2026\/05\/22\/whatley-backs-trumps-1-8b-anti-weaponization-fund-despite-gop-revolt-on-capitol-hill\/embed\/#?secret=RzMi13adfu#?secret=vSKhO8kAWV\" style=\"position: absolute; visibility: hidden;\" title=\"\u201cWhatley backs Trump\u2019s $1.8B \u2018anti-weaponization fund\u2019 despite GOP revolt on Capitol Hill\u201d \u2014 NC Newsline\" width=\"500\"><\/iframe><\/p>\n<p>The prospect that the fund would pay Trump\u2019s supporters, including those who assaulted police officers during the Jan. 6, 2021, U.S. Capitol riot, sparked multiple lawsuits, including the filing in Virginia.\u00a0<\/p>\n<p>Challengers included a former Department of Justice Jan. 6 prosecutor who was fired last year and a protester at an immigration raid last year who was charged with a felony, and has since been acquitted by a jury. The plaintiffs are represented by the legal advocacy groups Democracy Forward and Common Cause.\u00a0<\/p>\n<p>The Department of Justice announced the creation of the fund, in the amount of $1.776 billion, on May 18 in exchange for President Donald Trump voluntarily dropping his $10 billion lawsuit against the IRS for the leak of his tax returns nearly seven years ago.<\/p>\n<h4>Issue not moot, judge says<\/h4>\n<p>During a hearing that lasted less than an hour, Brinkema swiftly called Andrew Block,\u00a0senior counsel to the U.S. associate attorney general, to speak first.<\/p>\n<p>\u201cYou\u2019re a brave man, Mr. Block. You\u2019re all by yourself. Frankly, you\u2019re in the hot seat,\u201d Brinkema said, noting that Block was the only representative for the government in the courtroom.<\/p>\n<p>Brinkema kicked off questioning by asking Block if he\u2019d had a chance to find an answer to why Blanche has not formally rescinded the \u201canti-weaponization\u201d fund in writing.\u00a0<\/p>\n<p>The question had been posed to Block by U.S. District Judge Richard Leon in U.S. District Court for the District of Columbia less than 48 hours ago\u00a0during a hearing for a separate lawsuit against the fund. Block, who also appeared alone before Leon, told the judge he did not know the reason Blanche had not issued a written order.<\/p>\n<p>\u201cDo you have an answer to that question now?\u201d Brinkema asked.<\/p>\n<p>\u201cYour honor, I don\u2019t. I don\u2019t have the ability to speak to the AG,\u201d he responded.<\/p>\n<p>As he did in federal court June 10, Block argued that Blanche testified publicly before Congress that the administration was not moving forward with the fund, and that Blanche had signed legal briefs on the matter.<\/p>\n<p>Acknowledging those arguments, Leon denied an emergency request to block the fund, saying the case appeared \u201cmoot.\u201d<\/p>\n<p>Read more <a href=\"https:\/\/northcarolinamovingjournal.com\/?p=430\">As ICE presence at World Cup looms, fans and local leaders prepare<\/a><\/p>\n<p>Brinkema, however, said she does not agree with Leon\u2019s assessment.\u00a0<\/p>\n<p>Doubting whether any of Blanche\u2019s verbal or written statements to stop the fund had been made under penalty of perjury, Brinkema said, \u201cthat means the issue, in my view, is not moot.\u201d<\/p>\n<p>Brinkema also cited Trump\u2019s public comments praising the fund, even after Blanche\u2019s declaration it would not move forward.<\/p>\n<p>\u201cWhen the president of the United States says he\u2019s going to be disappointed if something doesn\u2019t happen, that\u2019s a pretty good indication that it (could) happen,\u201d Brinkema said.<\/p>\n<p>\u201cThere are a lot of people out there who think this fund is up and running,\u201d she added.<\/p>\n<p>Block responded: \u201cPeople may think a lot of things.\u201d He said \u201cwhat I can tell you\u201d is that no commissioners have been appointed to the fund to establish a claim system.<\/p>\n<h4>No lawful business restrained<\/h4>\n<p>Block, as he did before Judge Leon, dismissed the plaintiffs\u2019 allegations as \u201cwhat-ifs,\u201d based on a \u201cloose factual record that is premature.\u201d<\/p>\n<p>Referring to the departments of Justice and Treasury, Brinkema asked, \u201cWhat injury do they face if the court issues a preliminary injunction at this point?\u201d<\/p>\n<p>Block argued any temporary order to block the fund would mean the government was being \u201crestrained\u201d in conducting business.<\/p>\n<p>\u201cYou think this is lawful business? This is a serious issue,\u201d Brinkema said, adding the \u201conly reason this fund exists\u201d is because it\u2019s a settlement in the president\u2019s IRS case, which is \u201cunder severe scrutiny.\u201d<\/p>\n<p>U.S. District Judge Kathleen Williams, in the Southern District of Florida, has\u00a0 for the government\u2019s response by day\u2019s end to a May 27 request from 35 former federal judges to reopen the case.
