{"id":487,"date":"2026-06-17T21:35:40","date_gmt":"2026-06-17T21:35:40","guid":{"rendered":"https:\/\/northcarolinamovingjournal.com\/?p=487"},"modified":"2026-06-17T21:35:40","modified_gmt":"2026-06-17T21:35:40","slug":"nc-senators-advance-bill-shifting-involuntary-commitment-evaluations-to-jails","status":"publish","type":"post","link":"https:\/\/northcarolinamovingjournal.com\/?p=487","title":{"rendered":"NC senators advance bill shifting involuntary commitment evaluations to jails"},"content":{"rendered":"<div>\n<p><span>A key North Carolina state senate panel approved a bill Wednesday aiming to fix a problem lawmakers inadvertently caused by changing public safety laws in the wake of the 2025 killing of Iryna Zarutska by a person with mental illness.\u00a0<\/span><\/p>\n<p>Read more <a href=\"https:\/\/northcarolinamovingjournal.com\/?p=485\">Groups sue Robeson County over PFAS in county drinking water<\/a><\/p>\n<p><span>In the fall, the legislature <\/span><span>approved<\/span><span> \u201cIryna\u2019s Law,\u201d a judicial reform package keeping more suspects in custody before their trials and requiring more of them to be taken to hospitals for psychiatric assessments and potential involuntary commitment.\u00a0<\/span><\/p>\n<p><span>But concerns from stakeholders plagued lawmakers. Hospital leaders were worried about the safety of patients and staff when suspects are evaluated in emergency rooms, saying they\u2019d prefer those assessments take place in jail.\u00a0<\/span><\/p>\n<p><span>Bill sponsor Rep. Timothy Reeder (R-Pitt), a physician, told the Senate Health Care Committee Wednesday that <\/span><span>House Bill 1104<\/span><span> would allow those evaluations to take place in jails instead. He said it isn\u2019t a fix for the shortcomings of the state\u2019s mental health system, but it\u2019s a step forward.<\/span><\/p>\n<p><span>Reeder said he still works in the emergency department.\u00a0<\/span><\/p>\n<p><span>\u201cI worked there last Friday, and we had no fewer than 30 psychiatric patients in our emergency department,\u201d he said. \u201cYou wouldn\u2019t want someone who has a violent history sitting next to your child who\u2019s getting treated for an ear infection.\u201d\u00a0<\/span><\/p>\n<p><span>Sen. Natalie Murdock (D-Durham) said she went to the emergency room twice in the past six months.\u00a0<\/span><\/p>\n<p><span>Law enforcement officials are there almost on a daily basis dealing with \u201call sorts of issues,\u201d she said.\u00a0<\/span><\/p>\n<p><span>\u201cFrom my own experience I was concerned about the safety of staff, and could clearly tell some of the issues were mental, which is why they were brought there,\u201d Murdock said.\u00a0<\/span><\/p>\n<p><span>About 40% of the evaluations for involuntary commitment in emergency departments are already conducted through telehealth, according to Reeder.\u00a0<\/span><\/p>\n<p><span>\u201cWe are going to be using telehealth for the evaluations in jails, which is the primary component of this bill,\u201d Reeder said Wednesday. \u201cWe believe that the jails are the appropriate place to do this.\u201d<\/span><\/p>\n<p><span>He said mobile crisis teams \u2014\u00a0trained behavioral health specialists who travel directly to individuals experiencing a mental health emergency \u2014\u00a0can be used if telehealth isn\u2019t available.<\/span><\/p>\n<blockquote>\n<p>NC lawmakers weigh changes to involuntary commitment, guardianship under Iryna\u2019s Law<\/p>\n<p>Read more <a href=\"https:\/\/northcarolinamovingjournal.com\/?p=483\">NC legislators report state budget progress<\/a><\/p>\n<\/blockquote>\n<p><iframe loading=\"lazy\" class=\"wp-embedded-content\" data-secret=\"heI1AXwl2o\" frameborder=\"0\" height=\"282\" marginheight=\"0\" marginwidth=\"0\" sandbox=\"allow-scripts\" scrolling=\"no\" security=\"restricted\" src=\"https:\/\/ncnewsline.com\/2026\/03\/18\/nc-lawmakers-weigh-changes-to-involuntary-commitment-guardianship-under-irynas-law\/embed\/#?secret=iZDh2izsmA#?secret=heI1AXwl2o\" style=\"position: absolute; visibility: hidden;\" title=\"\u201cNC lawmakers weigh changes to involuntary commitment, guardianship under Iryna\u2019s Law\u201d \u2014 NC Newsline\" width=\"500\"><\/iframe><\/p>\n<p><span>Under Iryna\u2019s Law, criminally violent individuals can\u2019t be released before trial. Sen. Julie Mayfield (D-Bumcombe) asked if H1104 factored in staff issues at jails.\u00a0<\/span><\/p>\n<p><span>\u201cDoes this bill address the current and ongoing problem that we have across the state in terms of overcrowding at our jails, which I hear every sheriff attributing to Iryna\u2019s Law?\u201d she asked.<\/span><\/p>\n<p><span>Reeder said there\u2019s about 300 beds in state psychiatric facilities that aren\u2019t available due to staff shortages, but work is underway to change that. State leaders\u2019 proposed budgets also contain raises for correctional officers.\u00a0<\/span><\/p>\n<p><span>N.C. Department of Health and Human Services Deputy Secretary Dr. Carrie Brown said DHHS is working on opening \u201cjustice units\u201d to house inmates and suspects across the state\u2019s three psychiatric hospitals by Dec. 1.<\/span><\/p>\n<p><span>Brown said they\u2019re working with existing funding to find ways to avoid using contract staff, which would be more expensive.\u00a0<\/span><\/p>\n<p><span>\u201cWe have three postings for each of the hospitals\u2026 offering some pretty aggressive graduated sign-on bonuses,\u201d she said. \u201cWe are hoping that this will be a very cost-effective way to get full-time staff.\u201d<\/span><\/p>\n<p><span>Reeder also brought up the safekeepers program, which provides more treatment for people with mental illness in jails.\u00a0<\/span><\/p>\n<p><span>\u201cSome of the challenges in the jails is that they\u2019re not delivering ongoing mental health treatment, which makes it more difficult to take care of those people in custody,\u201d Reeder said. \u201cIf we have some availability of resources, we hope and believe that that\u2019s actually going to make it easier to take and deliver some of the services in the current system.\u201d<\/span><\/p>\n<p><span>Ashley Perkinson, an attorney speaking on behalf of the North Carolina College of Emergency Physicians, thanked the committee for their work on the bill.\u00a0<\/span><\/p>\n<p><span>\u201cThis is an issue, of course, that is very important to emergency physicians across the state,\u201d she said. \u201cWe look forward to continued partnership to improve the involuntary commitment process across North Carolina.\u201d<\/span><\/p>\n<p>Read more <a href=\"https:\/\/northcarolinamovingjournal.com\/?p=481\">NC House committee okays a sweeping election bill, but its sponsor says it needs more work.<\/a><\/p>\n<p>The measure could be on the state Senate floor next week.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The measure makes changes to \u201cIryna\u2019s Law,\u201d a 2025 criminal law package requiring more suspects to receive psychiatric evaluations and remain in custody before trial.<\/p>\n","protected":false},"author":1,"featured_media":486,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"class_list":["post-487","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-interesting"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.6 -
